Bus Accidents

Due to increasing congestion on roadways, more and more commuters are turning to rapid transit and public transportation each year. With the growing number of people using buses as their primary source of transportation, the number of injuries and deaths resulting from bus accidents continues to rise.

23.5 million elementary and secondary school children throughout the United States ride school buses twice daily. Many of those school buses do not have restraint systems or seatbelts, and 12,000 children are injured each year in school bus accidents. Although the majority of the injuries are minor, some are catastrophic, and as many as 11 children a year die as a result of a school bus accident.

Bus accidents often result in serious injury or death. Contributing factors to bus accidents can include, but are not limited to, driver negligence, inadequate security, dangerous roadways, weather conditions, defective products, improper maintenance, and other forms of negligence.

If you have been injured due to a bus accident, or if your child has been injured while riding on a school bus, you may be able to file a claim against the bus company to recover for your damages. Even if you were involved as a pedestrian, a passenger of the bus, or the driver or passenger of another vehicle involved in the accident, you are eligible to file a claim. If you were a passenger on a bus involved in an accident, the company operating the bus, whether public or private, owes you the "duty of utmost care," which is higher than the negligence duty owed to drivers of other vehicles and pedestrians.

Claims for damages against a public entity or governmental entity are complex and have strict time limitations. The laws vary greatly dependant upon the circumstances surrounding the accident. If you have been injured in an accident involving a bus or school bus, you should seek the advice of a qualified bus accident injury lawyer immediately.
